305 PROCEDURES Rezoning 20 Chapter Franklin Zoning Ordinance Effective July 1, 2024 construction, major repairs, alterations, additions, restoration, rehabilitation, demolition or relocation of any building, object or structure on the property shall be subject to the certificate of appropriateness procedures, unless the rezoning is denied by the BOMA. 20.7.11 NCO District Rezoning A rezoning to the NCO shall vary from the process in Section 20.7, Rezoning, to meet the following requirements: A. Properties may be nominated for the NCO by a representative of the property owners; B. The nomination shall serve as an application to rezone the affected properties into the NCO. The rezoning shall vary from the process in Section 20.7, Rezoning, to meet the following requirements: 1. The application fee shall be waived; 2. The nomination shall indicate the map, group, and parcel numbers of the properties proposed for rezoning. A survey of the affected properties shall not be required; and 3. A petition shall be submitted, signed by at least 51 percent of the total number of property owners of the total number of parcels or lots within the proposed district. An owner affidavit shall not be required. 4. Following the nomination of the NCO, the Department of Planning and Sustainability shall hold a neighborhood meeting with the affected property owners. 5. Following the neighborhood meeting, the Department of Planning and Sustainability shall develop maps, descriptive materials, and development standards for the proposed district that include: a. Maps indicating the boundaries, age of structures, and existing land use; b. Maps and other graphic and written materials identifying and describing the distinctive neighborhood and building characteristics of the proposed district; and c. Development standards for new construction, additions, or alterations to the street facades of existing buildings or structures within the proposed district. 6. The development standards shall be established by a text amendment and rezoning creating the NCO. C. Separate ordinances are required to designate each district. Ordinances designating each NCO shall identify the designated district boundaries and specify the individual purposes and development standards for that individual district. D. Each NCO shall have the overlay district symbol (NCO) as a suffix and be numbered sequentially to distinguish among different districts e.g. (NCO1, NCO2, etc.).
