169 STREETS AND CIRCULATION Pedestrian Circulation 09 Chapter Franklin Zoning Ordinance Effective January 1, 2023 Sidewalk Location Minimum Width Along Streets or Internal Drives In accordance with Transportation and Street Technical Standards, but in no case less than 5 feet Where Abutting Parking Spaces 7 feet Where Abutting a Commercial/MixedUse or Civic Building 8 feet In the DD, 1ST, or 5TH Districts 12 feet, with at least 8 feet continuously unobstructed by street tree pits, light poles, or similar features. A reduced width may be permitted due to existing obstructions C. Sidewalk materials shall comply with the Transportation and Street Technical Standards. D. Sidewalks shall be raised above adjacent driving surface and may be raised at vehicular crossings as a traffic- calming measure. 9.6.3 Multi-Use Paths A. Multi-use paths shall be designed and constructed per the Transportation and Street Technical Standards. B. Multi-use paths shall have a minimum width of 12 feet. The width may be reduced to ten feet in portions of the path to minimize disturbance to existing vegetation or other environmental constraints. C. Multi-use paths shall be placed either in a public right-of-way or in a 24-foot wide public access easement. D. In the 1ST district, a multi-use path shall be located along the Harpeth River with pedestrian access points to E. Main St and 1st Avenue N and S. 9.6.4 Nature Trails Nature trails may be constructed of natural materials, such as grass, gravel, dirt, or mulch. 9.6.5 Sidewalks Fees In-Lieu A. Payment of fees in-lieu of installing a required public sidewalk may occur only when: 1. The timing of the installation of the sidewalk would result in its removal shortly thereafter due to a fully-funded street widening, streetscape project, or other capital improvement project; or 2. The right-of-way, developing lot, or lot abutting a required sidewalk is not suitable for sidewalks due to floodplain, wetlands, riparian buffers, tree save areas, HHO, or naturally-occurring slopes exceeding 20 percent. B. The determination of whether payment of fees in-lieu are appicable shall be reviewed by the DRT or FMPC as part of the development plan, site plan, or final plat. If the BOMA decides to waive a sidewalk requirement by MOS, then fees-in-lieu shall be required. C. The fees in-lieu of sidewalks shall be paid prior to: 1. Recording the final plat; or 2. Issuance of a building permit or a grading permit when a final plat is not required. D. Fees received pursuant to this Subsection shall be used in accordance with the City Sidewalk Fund.
