301 PROCEDURES Text Amendment 20 Chapter Franklin Zoning Ordinance Effective January 1, 2023 20.5 Text Amendment 20.5.1 Purpose The purpose of a text amendment is to modify the provisions of this Ordinance to address changed conditions, changes in public policy, or changes necessary to advance the health, safety, and welfare of the City. 20.5.2 Applicability Text amendments shall comply with the specific review procedures in this Section. 20.5.3 Application Submittal A text amendment application shall be initiated by the BOMA, FMPC, or Department of Planning and Sustainability. 20.5.4 Joint Conceptual Workshop The Department of Planning and Sustainability shall draft the text amendment and present it at a joint conceptual workshop. 20.5.5 FMPC Recommendation The FMPC shall review the text amendment at a public meeting and make a recommendation to the BOMA. 20.5.6 BOMA Final Action A. The BOMA shall hold three readings on the text amendment, with a public hearing during the second reading, and vote for: 1. Approval; 2. Approval with conditions; 3. Disapproval; or 4. Deferral for continued review of the application. B. A majority vote of the full membership of the BOMA shall be required for passage of the text amendment ordinance on third and final reading. 20.5.7 Approval Criteria Recommendations and final action on a text amendment shall be based on consideration of the following criteria: A. Whether the proposed text amendment is consistent with Envision Franklin and the purpose of this Ordinance; B. Whether the proposed text amendment will protect the health, safety, and welfare of the public; and C. Whether the proposed text amendment corrects an error or meets the challenge of some changing condition, trend, or fact since the time that the original text was established.
