65 OVERLAY ZONING DISTRICTS General Provisions 04 Chapter Franklin Zoning Ordinance Effective January 1, 2023 4.1 General Provisions 4.1.1 Overlay Zoning Districts Overlay districts shall be in addition to and shall overlay the zoning districts in Chapter 3, Zoning Districts. For the purposes of this Ordinance, the following overlay zoning districts are applied to certain properties as set forth on the zoning map: FWO Floodway Overlay District FFO Floodway Fringe Overlay District HHO Hillside/Hillcrest Overlay District HPO Historic Preservation Overlay District NCO Neighborhood Conservation Overlay District CAO Columbia Avenue Overlay District CFO Central Franklin Overlay District SCO Scenic Corridor Overlay District 4.1.2 Conflicting Provisions Where the standards of the overlay district and the underlying zoning district differ, then the overlay standard shall apply, unless specifically referenced in another Chapter or Section by a provision to override an overlay district. 4.2 FWO—Floodway Overlay District 4.2.1 Purpose The FWO district is intended to: A. Preserve the portion of the floodplain that carries the flow of water during storm and flood events; B. Prevent an increase in flood height that may result in the loss of life or property damage; and C. Restrict development, improvements, uses, and encroachments that would impede or obstruct the water flow. 4.2.2 Conflicting Provisions In cases of conflict between the standards of the FWO and the 1ST districts, the regulations of the 1ST district shall apply, as applicable. 4.2.3 District Boundaries The FWO boundaries shall coincide with the boundaries of floodways, as adopted in Section 17.6, Floodplain Protection. 4.2.4 Permitted Uses The following uses are the only uses permitted in the FWO, subject to Section 17.6, Floodplain Protection, and the Stormwater Management Ordinance: A. Passive parks and natural areas; B. Active recreation features that are Cityowned and operated, provided that all fencing, walls, and permanent structures are located outside of the ten-year flood zone; C. Parking areas for public parks that are Cityowned and operated; D. Golf courses, excluding permanent structures; E. Seasonal agricultural sales, subject to Section 5.3, Temporary Uses and
