04 70 Chapter HPO—Historic Preservation Overlay District OVERLAY ZONING DISTRICTS Franklin Zoning Ordinance Effective January 1, 2023 4.5 HPO—Historic Preservation Overlay District 4.5.1 Purpose The HPO district is intended to: A. Preserve and protect historic or architecturally worthy buildings, structures, sites, landmarks, monuments, streetscapes, landscapes, cemeteries, walls, squares, neighborhoods, and archaeological sites; and B. Safeguard the character of the district as a whole and individual property therein that embody important elements of its social, economic, cultural, political or architectural history. 4.5.2 Conflicting Provisions Where the Historic District Design Guidelines and any requirement of this Ordinance conflict, the Historic District Design Guidelines shall take precedence. The resulting certificate of appropriateness shall be eligible for site plan, building permit, or sign permit approval, as applicable. 4.5.3 District Boundaries and Designation Criteria The HPO shall be comprised of many individual historic districts of various sizes and geographic areas. The following criteria shall be used to determine HPO districts: A. The quality of significance in American history, architecture, archaeology, and culture is present; B. Sites, buildings, or structures possess integrity of location, design, setting, materials, workmanship, feeling, or association with events that have made a significant contribution to the broad patterns of history or with the lives of persons significant in the past; C. Sites, buildings, or structures embody the distinctive characteristics of a type, period, or method of construction or that represent the work of a master, or that possess high artistic value, or that represent a significant and distinguishable entity whose components may lack individual distinction; D. Sites, buildings, or structures have yielded, or may be likely to yield, archaeological information; or E. Sites, buildings, or structures are listed in the National Register of Historic Places. 4.5.4 Certificate of Appropriateness Construction, alteration, rehabilitation, relocation, or demolition in the HPO may be performed only when an application has been submitted and reviewed considering the Historic District Design Guidelines, and a certificate of appropriateness has been issued. For certain development applications, a preliminary recommendation by the HZC shall be required prior to issuance of a certificate of appropriateness. See Section 20.11, Certificate of Appropriateness. 4.5.5 Signs Signs in the HPO may be installed only when the sign has received a certificate of appropriateness and sign permit. 4.5.6 Maintenance and Repair of Structures A. Property owners shall perform routine maintenance and repairs to maintain the exterior of structures in the HPO in conformance with this Ordinance, the Municipal Code, the Historic District Design Guidelines, and all applicable building codes.
