All required certifications 4.4 Variations and Exceptions Whenever a parcel of land to be subdivided is of such unusual size or shape, or is surrounded by such development of unusual conditions that the strict application of the requirements contained in these regulations would result in substantial hardship or inequity, the FMPC may vary or modify, except as otherwise indicated, such requirements of design, but not of procedure or improvements, so that the applicant may develop the property in a reasonable manner, keeping in mind that the public welfare and interests of the City are protected and the general intent and spirit of these regulations are preserved. Such modifications may be granted by the FMPC upon written request by the applicant, stating the reason(s) for each modification. 4.5 Appeals An appeal of any action or decision rendered by the FMPC pursuant to these regulations shall be to any Court of competent jurisdiction.
