167 PARKING AND TRANSIT Parking 10 Chapter Franklin Zoning Ordinance Effective December 30, 2019 10.1 Parking 10.1.1 Applicability This Chapter shall apply to: A. New development; B. An existing structure or use that will be expanded or increased in capacity; or C. A change in use that will result in increased vehicle trips. 10.1.2 Exemptions Within the DD district, legally established uses and buildings in existence on the effective date of this Ordinance shall comply with the following: A. When a commercial use is changed to another commercial use, additional parking spaces a re not required; B. When a building is expanded, additional parking spaces are required for the new square footage only; and C. When a building is torn down and a new building is constructed, parking spaces shall comply with the standards of this Section and required for the entire square footage of the new building. 10.1.3 Review for Compliance Review for compliance with this Chapter shall occur with a development plan, site plan, building permit, or certificate of occupancy, as applicable. 10.1.4 Parking Plan A. A parking plan shall be submitted with any development that is required to provide more than three parking spaces. B. The parking plan shall accurately designate the required parking spaces, landscape islands , aisles, driveways , internal drives , and circulation and mobility around the development. 10.1.5 Calculation of Minimum Parking A. Parking spaces shall be required per the table in Subsection 10.1.6, Minimum Parking. B. For combinations of uses, the minimum shall be the sum of the requirement for each use. No parking space for one use can be included in the calculation of a parking requirement for any other use, except as permitted by Paragraph, 10.1.10.A, Shared Parking. C. When the minimum is listed as variable or if a use is not covered under Subsection 10.1.6, Minimum Parking, then the applicable City department: 1. May determine the minimum based on the closest comparable use; or 2. May approve an alternate standard based on a parking study that provides justification using: a. A nationally-accepted standard parking resource or comparable uses and cities, as approved by the Department of Planning and Sustainability; b. The size and type of the proposed development and the composition of uses; c. Anticipated rate of parking turnover; and d. Anticipated peak parking and traffic loads for all uses.
