20 304 Chapter Rezoning PROCEDURES Franklin Zoning Ordinance Effective December 8, 2020 20.7.9 Establishment of a Zoning District A. The applicant shall submit a rezoning application concurrently with an annexation application. The zoning district shall comply with one of the following: 1. The property shall be zoned AG or ER, depending on the size. 2. The property shall be zoned to a specific zoning district that achieves the design concept recommendations in Envision Franklin. 3. The property shall be zoned PD with an accompanying development plan. 4. Any property subject to a recorded subdivision shall be zoned to the district that most closely resembles the existing development in terms of uses and lot sizes. If such district is PD, final plats on record in the Williamson County Register’s office shall serve as the development plan. B. In addition to the zoning district, parcels annexed into the City shall be zoned to the applicable zoning overlay districts in accordance with Envision Franklin. C. When a property is zoned or rezoned, the new zoning district lines shall follow parcel lines. 20.7.10 HPO District Rezoning A rezoning to the HPO shall vary from the process in Section 20.7, Rezoning, to meet the following requirements: A. Properties may be nominated for the HPO by any of the following applicants: 1. An individual property owner of a property; 2. One person, acting as a representative for more than one property owner; or 3. The BOMA or HZC. B. The nomination shall serve as an application to rezone the affected properties into the HPO. The rezoning shall vary from the process in Section 20.7, Rezoning, to meet the following requirements: 1. The application fee shall be waived; 2. The nomination shall indicate the map, group, and parcel numbers of the properties. A survey of the affected properties shall not be required; and 3. Anowner affidavit shall not be required. C. Upon receipt of a nomination, the Department of Planning and Sustainability shall place the item for consideration on an upcoming HZC meeting agenda to evaluate the affected properties in light of the HPO designation criteria. The HZC shall make a recommendation to the FMPC. D. The Department of Planning and Sustainability shall prepare a notice of nomination and mail it to the owners of the affected properties at least 15 days prior to the FMPC meeting. The notice of nomination shall include the following information: 1. A description of the structure or site proposed for nomination; 2. A description of the benefits, restrictions, and other terms of the proposed designation; 3. Notice of the FMPC meeting; 4. A statement of the stay of actions after nomination provided for in Clause 20.7.10.F below; and 5. A formon which the owner may explain the reasons why the nomination should be approved or denied. E. The FMPC shall make a recommendation to the BOMA. F. After a first reading vote by the BOMA on the HPO rezoning, all permits for construction, major repairs, alterations, additions, restoration, rehabilitation,
