04 66 Chapter FFO—Floodway Fringe Overlay District OVERLAY ZONING DISTRICTS Franklin Zoning Ordinance Effective July 1, 2024 Structures; and F. Garage/yard sales, subject to Section 5.3, Temporary Uses and Structures. 4.2.5 Permitted Encroachments The following encroachments are the only encroachments permitted in the FWO, subject to Section 17.6, Floodplain Protection, and the Stormwater Management Ordinance: A. Public and private infrastructure; and B. Event tents, subject to Section 5.3, Temporary Uses and Structures. C. Minimal floodway alteration for uses and encroachments permitted by Subsections 4.2.4, Permitted Uses, and 4.2.5, Permitted Encroachments. 4.2.6 Exemptions Historic structures within the HPO shall be used in accordance with the permitted uses in the underlying zoning district. Historic structures may be altered or subjected to major repair, subject to Section 17.6, Floodplain Protection, and Section 20.11, Certificate of Appropriateness. 4.2.7 Prohibited Development Any portion of land within the FWO shall be placed in an open space lot and noted on the final plat as non-buildable. 4.3 FFO—Floodway Fringe Overlay District 4.3.1 Purpose The FFO district is intended to: A. Preserve the holding capacity of the floodway fringe; B. Limit uses and encroachments that would impede or obstruct the holding capacity of the floodway fringe; and C. Prevent an increase in flood height that may result in the loss of life or property damage. 4.3.2 Conflicting Provisions In cases of conflict between the standards of the FFO and the 1ST or 5TH districts, the regulations of the 1ST or 5TH district shall apply, as applicable. 4.3.3 District Boundaries The FFO boundaries shall coincide with the boundaries of the 100-year floodplain, excluding floodways, as adopted in Section 17.6, Floodplain Protection. 4.3.4 Permitted Uses The following uses are the only uses permitted in the FFO, subject to Section 17.6, Floodplain Protection, and the Stormwater Management Ordinance: A. Passive parks and natural areas; B. Active recreation facilities, provided that all fencing, walls, and permanent structures are located outside of the ten-year flood zone. Active recreation facilities are subject to development plan approval; C. Golf courses, excluding permanent structures; D. Parking areas, subject to Section 5.2, Accessory Uses and Structures; E. Seasonal agricultural sales, subject to
